Terms of Service

These Terms of Service ("Terms") govern your use of the Pirch platform, including the pirch.co website, dashboard, chat widget, and related services (collectively, the "Service") operated by Pirch ("we," "us," or "our"). By using the Service, you agree to these Terms.

1. Accounts

To use the Service as a business, you must create an account and provide accurate information. You are responsible for maintaining the security of your account and for all activity under it. You must be at least 18 years old to create an account.

2. The Service

Pirch provides a chat widget and customer engagement platform for businesses. The Service includes automated chat responses, appointment booking, lead capture, live chat, email campaigns, and analytics. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

3. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or to violate any laws
  • Transmit spam, malware, or harmful content through the chat widget
  • Attempt to gain unauthorized access to the Service or other users' accounts
  • Use the Service to collect information from minors under 13
  • Interfere with or disrupt the Service infrastructure
  • Resell or redistribute the Service without our written consent
  • Use the Service to provide medical, legal, or financial advice without appropriate professional qualifications

4. Your Content

You retain ownership of all content you upload to the Service (knowledge base content, business information, images, etc.). By uploading content, you grant us a license to use it solely for the purpose of providing the Service to you. We do not use your content to train models or for purposes unrelated to your account.

5. Visitor Data

When visitors interact with your chat widget, their conversation data, contact information, and interaction events are collected and stored on your behalf. You are the data controller for your visitors' data and are responsible for complying with applicable privacy laws (GDPR, CCPA, etc.) in your jurisdiction. 6. Automated Responses

The Service uses large language models to generate chat responses based on your business content. While we strive for accuracy, automated responses may occasionally contain errors or inaccuracies. You are responsible for reviewing and managing the quality of responses your visitors receive. We recommend configuring fallback messages and live chat handoff for sensitive topics.

7. Payment and Billing

Paid plans are billed monthly or annually in advance. All fees are non-refundable except as required by law. We may change pricing with 30 days' notice. If your payment fails, we may suspend access to paid features until payment is resolved.

8. Intellectual Property

The Service, including its design, code, and branding, is owned by Pirch and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or branding beyond what is necessary to use the Service (e.g., the "Powered by Pirch" badge in the widget).

9. Limitation of Liability

To the maximum extent permitted by law, Pirch shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that automated responses will be accurate or appropriate for your use case.

11. Termination

Either party may terminate these Terms at any time. You may close your account by contacting us. We may suspend or terminate your account for violation of these Terms. Upon termination, your data will be retained for 30 days and then deleted, unless you request earlier deletion or a data export.

12. Governing Law

These Terms are governed by the laws of the State of Missouri, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Jackson County, Missouri.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or a notice in the dashboard. Continued use of the Service after changes constitutes acceptance of the updated Terms.
